Naming Someone to Act for You in Colorado

What These Documents Actually Authorize

August & Suchowski drafts powers of attorney for families across Jefferson County, Colorado. A power of attorney names an agent, the person allowed to act on your behalf, and it operates while you're living rather than after death.

There are two, and they do separate jobs. A financial power of attorney covers banking, property, and bills. A medical power of attorney covers treatment decisions, and it usually sits alongside an advance directive, your written instructions about care you do or don't want. Most people need all of it, and different people can hold each role.

Aging Parents, Young Families, and Anyone Facing Surgery

Most people who call our Jefferson County estate planning team are thinking about a specific person. A parent starting to slip. A spouse heading into a procedure. Themselves, after watching a friend's family get stuck.

The situations sound the same every time. "Mom can't handle her own bills anymore." "The bank won't talk to me." "He's in the hospital and nobody can sign anything."

Drafted to Be Accepted, Not Just Signed

Michael Suchowski leads estate planning at August & Suchowski and has practiced law since 2000. Liz August handles probate and guardianship-adjacent matters from our Wheat Ridge office, so this firm sees what happens to families whose documents were rejected or never existed.

That experience shapes the drafting. A document a bank refuses is worth nothing to the person holding it. Both attorneys are licensed in Colorado, and this is the only kind of work the firm takes.

Sign These Before You Need Them

Timing is the whole issue with these documents. Signing requires capacity, the legal ability to understand what you're authorizing. Once someone has lost that, the option closes and the family is looking at a court process instead. A diagnosis or an upcoming surgery is the moment to act.

Our Wheat Ridge office replies within one business day and the first consultation is free. Powers of attorney are typically handled on a flat fee, often alongside a will or trust, and quoted before drafting begins.

Serving Jefferson County and Colorado

Our Wheat Ridge office covers Lakewood, Arvada, Golden, Westminster, and Edgewater within roughly ten miles. Michael also meets clients by video anywhere in the state.

A financial power of attorney affecting real estate generally gets recorded with the county clerk where the property sits, which is Jefferson County for most of our clients. Hospitals and banks each have their own intake process too. These documents are part of the broader work found on our estate planning attorney page.

FAQs

What happens if my parent never signed one?

Once someone loses the ability to make decisions, a power of attorney can't be signed. Families in that position usually have to ask a Colorado court to appoint someone instead, which takes time and money. That's exactly the outcome these documents are meant to prevent.

Can one person handle both money and medical decisions?

They can, and plenty of families name the same person for both. Others split it, because the sibling who is good with money isn't always the one you want in a hospital conversation. We talk through both roles before anything gets drafted.

Does a power of attorney still work after I die?

No. The authority ends at death, and from that point the will, the trust, or the probate process takes over. This is the most common misunderstanding we hear. It's why these documents work alongside a will rather than replacing one.

My bank rejected the form we downloaded. Now what?

That happens often, because institutions apply their own review to these documents. A form that's too generic or too old frequently gets turned away. We draft with that acceptance problem in mind and can prepare a replacement.

Can I limit what my agent is allowed to do?

Yes. A power of attorney can be broad or narrowly scoped to specific powers, accounts, or a fixed period. Many Colorado families start narrow and expand it later. We'll ask what you actually want the person doing before drafting.
